General Terms of Sale

These sales conditions are concluded on one hand by the company CLASSIC GALLERY with a capital of 5,000 euros whose registered office is located in Quesnoy sur Deûle, 34 rue de la Gare, registered in the Lille trade and companies register under number 839 464 286 hereinafter referred to as "CLASSIC GALLERY" and on the other hand, by any natural or legal person wishing to make a purchase via the "Classic Gallery" website hereinafter referred to as "the buyer".

Subject: These sales conditions aim to define the contractual relationships between CLASSIC GALLERY and the buyer and the conditions applicable to any purchase made through the Classic Gallery website, whether the buyer is a professional or a consumer. The acquisition of a good or service through this site implies unconditional acceptance by the buyer of these sales conditions. These sales conditions will prevail over any other general or specific conditions not expressly agreed upon by Classic Gallery, which reserves the right to modify its sales conditions at any time. In this case, the applicable conditions will be those in effect on the date of the order by the buyer.

Characteristics of the goods and services offered:
The products and services offered are those listed in the catalog published on the CLASSIC GALLERY website. These products and services are offered within the limits of available stock. Each product is accompanied by a description prepared by us. The photographs in the catalog are as faithful as possible but cannot ensure a perfect similarity with the product offered, particularly regarding colors or materials.

Prices:
The prices listed in the catalog are inclusive of VAT in euros, taking into account the applicable VAT rate on the day of the order; any change in the rate may be reflected in the price of the products or services. Classic Gallery reserves the right to modify its prices at any time, it being understood that the price listed in the catalog on the day of the order will be the only one applicable to the buyer. The prices indicated do not include processing, transport, and delivery fees as long as they occur in the geographical areas provided below.

Geographical area: The online sale of the products and services presented on the site is reserved for buyers residing in France or in the territory of the European Community and for deliveries required in these geographical areas.

Orders:
The buyer who wishes to purchase a product or service must necessarily: 1> fill out the identification form on which they will provide all the requested contact details or give their customer number if they have one, 2> fill out the online order form by providing all the references of the chosen products or services, 3> validate their order after having verified it, 4> make the payment under the specified conditions, 5> confirm their order and payment. The confirmation of the order entails acceptance of these sales conditions, acknowledgment of having perfect knowledge of them, and waiver of relying on their own purchasing conditions or other conditions. All the data provided and the recorded confirmation will serve as proof of the transaction. The confirmation will serve as a signature and acceptance of the operations carried out. The seller will communicate by email confirmation of the recorded order.
 
Withdrawal: Buyers, non-professional natural persons, benefit from a withdrawal period of 15 days from the delivery of their order to return the product to the seller for exchange or refund without penalty, except for return shipping costs.
Payment methods: The price is due upon order. Payments will be made by bank transfer or via the Paypal service.  Payments by bank transfer: They will be made through the secure system of your bank which uses the SSL protocol
(Secure Socket Layer) so that the transmitted information is encrypted by software and that no third party can access it during transport over the network. Payments by Paypal: The buyer must fill in their information (username and password) to validate the transaction via the Paypal service website.
The buyer's account will be debited the amount of the products or services sent or downloaded before the shipment of the products or the execution of the services. At the buyer's request, a paper invoice showing the VAT will be sent to them.
 
Deliveries: Deliveries are made to the address indicated in the order form which can only be within the agreed geographical area. The risks are borne by the buyer from the moment the products have left the premises of CLASSIC GALLERY. In case of damage during transport, a justified complaint must be made to the carrier within three days from the delivery. Delivery times are given as an indication only and depend on actual availability with the carriers; if they exceed forty-five days from the order, the sales contract may be terminated and the buyer refunded.

Returns:
All claims, requests for exchange or refund must be made by post to the address below within 15 days following delivery.
Return shipping costs in case of exchange are the responsibility of the customer. Products must be returned to the following address:

The returned item(s) must be in good condition and returned in their original packaging, and placed in a parcel; they must not show any signs of use and must be accompanied by all their possible accessories. Discounted products are not refundable.

Warranty: All products supplied by the seller benefit from the legal warranty provided by articles 1641 and following of the Civil Code. In case of non-compliance of a sold product, it may be returned to the seller who will take it back, exchange it, or refund it. 

Liability: The seller, in the online sales process, is only bound by an obligation of means; their liability cannot be engaged for damage resulting from the use of the Internet network such as data loss, intrusion, viruses, service interruption, or other involuntary problems.

Intellectual property: All elements of the Classic Gallery site are and remain the intellectual and exclusive property of CLASSIC GALLERY. No one is authorized to reproduce, exploit, redistribute, or use in any way, even partially, elements of the site whether they are software, visual, or sound.
 
Dispute resolution: These online sales conditions are subject to French law. In case of dispute, jurisdiction is attributed to the competent courts of Lille, notwithstanding the plurality of defendants or third-party claims.
